Under Federal law qualified students with disabilities may be entitled to certain services or accommodations related to their school programming.
Students may be eligible for protection under Section 504 of the Rehabilitation Act of 1973 if they have a physical or mental impairment that substantially limits one or more major life activities; have a record of such impairment; or are regarded as having such impairment. Under Section 504, the handicapped child should receive an education that is comparable to the education provided to children who are not handicapped. To make education comparable, Section 504 plans often include classroom accommodations.
Public Act 96-0349 requires our district to annually inform parents of students with life-threatening allergies or life-threatening chronic illnesses, that they may be eligible for protection under Section 504 of the Rehabilitation Act of 1973. Not all students with life-threatening allergies and life-threatening chronic illnesses may be eligible. Our district may also be able to appropriately meet a student’s needs with an Educational Support Team plan and an Individualized Health Care Plan (IHCP).
